By using or embedding any MapFirst widget, SDK or API, or by registering as a MapFirst Partner, you agree to this Operating Agreement, the Program Policies, the Conditions of Use, and the MapFirst Privacy Policy.
This MapFirst API and SDK License Agreement ("Agreement") is between MapFirst, part of Biscotte GMBH, a company registered in Zurich, Switzerland (“MapFirst”, “we”, “us”, or “our”), and you ("Licensee"). By accessing or using the MapFirst API, SDK, documentation, or any related data (collectively, the "Services"), you agree to be bound by this Agreement.
If you do not agree, do not access or use the Services.
License Grant
1.1 MapFirst grants Licensee a limited, revocable, non exclusive, non transferable license to access and use the Services solely for the purpose of building websites, applications, or experiences that integrate MapFirst maps, widgets, links, or content.
1.2 This license is conditioned on strict compliance with this Agreement. Any use outside the scope described here is prohibited.
Ownership
2.1 MapFirst retains all rights, title and interest in the Services, including all data, listings, POI information, metadata, algorithms, and any underlying technology.
2.2 Licensee receives no ownership rights. Only the limited license described above.
Required Attribution and Linking
3.1 Licensee must always display the MapFirst attribution and any required branding elements in the manner specified by MapFirst.
3.2 All data, map elements, listings, POI information, and monetizable links provided by MapFirst must link back to MapFirst destinations or MapFirst click tracking URLs.
3.3 Licensee may not alter, block, hide, or redirect required links unless explicitly approved in writing.
3.4 Failure to correctly link to MapFirst or any attempt to mask or bypass MapFirst tracking URLs is a material breach of this Agreement.
Restrictions
Licensee must not:
4.1 Copy, scrape, download, store, or cache MapFirst data outside what is strictly needed for real time use.
4.2 Use the Services to create datasets, databases, competitor products, or derivative works based on MapFirst data.
4.3 Use the Services in a way that removes, replaces, or circumvents monetization provided by MapFirst.
4.4 Resell, sublicense, or provide MapFirst data to third parties without written permission.
4.5 Use automated scripts to extract large scale data.
4.6 Misrepresent MapFirst data as Licensee's own.
Data Integrity and Security
5.1 Licensee must maintain the security of all API keys and SDK integrations.
5.2 API keys are strictly personal and cannot be shared.
5.3 Licensee must immediately notify MapFirst if an API key is compromised.
Monitoring and Audit Rights
6.1 MapFirst may monitor API usage to ensure compliance.
6.2 Licensee agrees to provide reasonable access to logs or documentation if MapFirst suspects misuse or non compliance.
Termination
7.1 MapFirst may terminate this Agreement and revoke API/SDK access at any time for any reason, including:
• Attempting to use MapFirst data without linking back to MapFirst
• Attempting to circumvent monetization mechanisms
• Attempting to scrape or store MapFirst data
• Misuse of API keys
• Excessive requests or abusive traffic
• Violation of any term of this Agreement
7.2 Upon termination, Licensee must immediately stop using the Services and delete all MapFirst data, cached files, stored POIs, metadata, and any derivative materials.
7.3 Termination is final and MapFirst is not required to provide notice if the breach is severe.
No Warranty
The Services are provided on an "as is" and "as available" basis. MapFirst makes no warranties of any kind.
Limitation of Liability
To the fullest extent permitted by law, MapFirst will not be liable for any indirect, incidental, or consequential damages arising from this Agreement or your use of the Services.
Modification of the Agreement
MapFirst may update this Agreement at any time. Continued use of the Services after changes become effective constitutes acceptance.
Governing Law
This Agreement is governed by the laws of Switzerland. Any dispute shall be submitted to the exclusive jurisdiction of the courts of Zurich.
Changes to This Policy
We may update this Privacy Policy periodically to reflect changes in law, technology, or our services.
The latest version will always be posted at mapfirst.ai/legal/privacy.
Significant changes will be communicated through our website or partner channels.
