By using or embedding any MapFirst widget, SDK or API, or by registering as a MapFirst Partner, you agree to this Operating Agreement, the Program Policies, the Conditions of Use, and the MapFirst Privacy Policy.
Introduction
Welcome to the MapFirst Partner Program (“Program”). MapFirst, part of Biscotte GMBH, a company registered in Zurich, Switzerland (“MapFirst”, “we”, “us”, or “our”), provides digital tools that let publishers, influencers, destinations, and other partners embed interactive map experiences and earn eligible revenue from referred traffic.
This Agreement sets out the terms that apply to your participation in the Program and to any use of our widgets, SDKs, APIs, or related products.
Eligibility and Enrollment
2.1 Registered Partners
To become a registered Partner, you must submit an application through the MapFirst Partner Portal and receive written or electronic approval from us. Approval is at our sole discretion.
2.2 Unregistered Users
Anyone may embed or experiment with MapFirst widgets or APIs without formal registration. However, by doing so, you agree to comply with this Agreement and the Program Policies. Only registered Partners are eligible to receive payments or performance reports.
2.3 Accurate Information
You must provide accurate and current contact, payment, and tax information. You are responsible for updating these details as needed.
Use of Widgets, SDK and API
3.1 License
MapFirst grants you a limited, revocable, non-exclusive, non-transferable license to use the MapFirst widget, SDK, and API solely for embedding and displaying interactive maps on approved websites, apps, or social channels.
3.2 Restrictions
You must not:
modify, reverse-engineer, or interfere with our code, data, or tracking;
use the widget or API for scraping, automated queries, or resale;
display MapFirst content in contexts that are unlawful, misleading, defamatory, pornographic, or otherwise brand-unsafe;
combine our tools with software that collects user data beyond what is required for basic map interaction;
misrepresent MapFirst’s affiliation, or suggest that MapFirst endorses you or your products.
3.3 Removal and Access Control
MapFirst may suspend, restrict, or terminate your access to the widget, SDK, or API at any time if we believe your implementation breaches this Agreement, the Program Policies, or applicable law.
Earnings, Tracking and Payments
4.1 Eligible Clicks
Registered Partners may earn revenue on eligible click-throughs that originate from valid MapFirst widgets or links placed in compliance with this Agreement and the Program Policies.
4.2 Invalid Activity
Clicks generated through self-referrals, bots, incentivized traffic, paid click farms, or other artificial means are invalid and not eligible for payment.
4.3 Payment Terms
MapFirst will issue payments once your account balance meets the minimum threshold set out in the Program Policies. Payments are made in the currency and method we specify. All amounts are subject to validation and applicable taxes.
4.4 Audit Rights
MapFirst reserves the right to audit traffic sources and implementations. Fraudulent or non-compliant activity may lead to account suspension and forfeiture of unpaid earnings.
Content and Brand Safety
You are solely responsible for the content and operation of your site, app, or channel where MapFirst is embedded. You must:
ensure all content complies with data-protection, privacy, and advertising laws;
maintain a visible privacy notice explaining third-party tracking and cookies;
obtain any user consents required under GDPR, Swiss, or other local laws;
keep your implementation technically compatible with current versions of the MapFirst SDK or API.
Intellectual Property
All intellectual property in the MapFirst platform, design, code, and data belongs to Hoot Creative SARL or its licensors. You may use our trademarks or logos only as permitted in the Program Policies and solely to identify participation in the Program.
Any feedback or suggestions you provide become MapFirst’s property without obligation to you.
Data, Privacy, and User Consent
Use of MapFirst tools involves limited data exchange (e.g., click tracking, device type, location context). All processing is governed by the MapFirst Privacy Policy, which forms part of this Agreement.
You may not store, sell, or repurpose any MapFirst data except as expressly allowed in the Program Policies.
Term, Suspension and Termination
This Agreement begins when you first use or register for the Program and continues until terminated by either party.
MapFirst may suspend or terminate your participation, disable your access, or remove your widgets at any time with or without notice if you breach any term, create risk, or for business reasons.
Upon termination, all licenses end immediately, and you must remove all MapFirst code and materials from your properties.
Disclaimers and Limitation of Liability
The Program and all MapFirst services are provided “as is.” We make no warranties of any kind, express or implied.
MapFirst and Hoot Creative SARL are not liable for indirect, incidental, or consequential damages, including loss of revenue, data, or goodwill. Our total liability for any claim related to this Agreement will not exceed the total fees paid or payable to you in the twelve months preceding the claim.
Governing Law and Jurisdiction
This Agreement is governed by the laws of Switzerland. Any dispute shall be submitted to the exclusive jurisdiction of the courts of Zurich.
Updates to this Agreement
We may update or modify this Agreement at any time. Changes take effect when published on the MapFirst website. Continued use of the MapFirst widget, SDK, API, or Partner Portal after any change constitutes your acceptance of the new terms.
